Terms & Conditions

By accessing this platform, you agree to comply with and be bound by these Terms. If you disagree with any part of these terms, please do not use our services.

    • Users must provide accurate information during the registration process to access the limited services.
    • Users are responsible for maintaining the confidentiality of their account information and are liable for all activities occurring under their account.

    • MOCHI provides access to a variety of PMT services, including limited WhatsApp and SMS services, up to 50 staff accounts and storage services.
    • The limited services include:
      • Up to 1000 complimentary SMS messages per account upon signed up.
      • Up to 1000 WhatsApp messages per month.
      • Each account is subject to a limit of 50 users with an allocated storage capacity of 50GB.
    • Users requiring additional services beyond the specified limits may purchase these services as add-ons. The pricing for these additional services shall be in accordance with the rates outlined in item 2.2 of this service agreement.
    • Additional usage charges:
      • SMS: Prepaid top-up packages available (RM 500, RM 1000, RM 2000) with charges per SMS varying based on the recipient country.
      • WhatsApp: Prepaid top-up packages available (RM 500, RM 1000, RM 2000) with charges per WhatsApp message based on the usage type (business initiated or user initiated). For detailed pricing, refer to the attached Meta pricing link. https://developers.facebook.com/docs/whatsapp/pricing/ . WhatsApp Services may be subject to changes of Meta Policy.
      • User Access: RM58 for each additional user access, accompanied by an extra 1GB storage capacity, in the event that the limit of 50 users is surpassed.
      • Additional Storage: RM100 per 1TB (monthly recurring charges)
    • Services may be subject to changes or termination at the discretion of MOCHI.

    • MOCHI enforces strict limitations on the number of SMS and WhatsApp messages, staff accounts, and storage space allowed per user account, as specified in the service description.
    • Users requiring additional services beyond the specified limits may purchase these services as add-ons. The pricing for these additional services will be communicated by MOCHI and charged in accordance with the pricing plans defined.

    • Users must pay for additional services that exceed the limits set forth in their subscription plan.
    • Payments for additional services will be charged based on the pricing communicated by MOCHI.

    • Permitted Use: You may use the Site and the Content solely for your non-commercial, personal purposes and/or to learn about MOCHI products and services, and solely in compliance with these Terms of Use.
    • Prohibited Use: By accessing the Site, you agree that you will not:
      • Use the Site in violation of these Terms of Use.
      • Copy, modify, create a derivative work from, reverse engineer or reverse assemble the Site.
      • Sell, assign, sublicense, distribute, commercially exploit, or make available the Content or Service in any way.
      • Use any automated system that accesses the Site in a manner exceeding human usage.
      • Use the Site in a manner that damages, disables, or impairs any MOCHI website or interferes with others' use.
      • Mirror or frame the Site on any other website or web page.
      • Attempt to gain unauthorized access to the Site.
    • Any unauthorized use of any Content or the Site may violate patent, copyright, trademark, and other laws.

    • The Site, including all intellectual property rights, belongs to and is the property of MOCHI or its licensors (if any). MOCHI owns and retains all copyrights in the Content.
    • The Content may not be copied, reproduced, modified, published, uploaded, posted, transmitted, performed, or distributed in any way without permission.
    • MOCHI logos and other marks used are trademarks and the property of MOCHI. Users do not receive any right or license to use these.
    • Suggestions or feedback provided may be used by MOCHI without payment or condition.
    • Notifications of claimed copyright infringement should be sent to MOCHI's designated Copyright Agent.

    • You represent that you have all right, title, and interest to materials you post on the Site or provide to MOCHI ("Materials").
    • You agree that posted Materials do not violate any patent, copyright, trademark, trade secret, right of privacy, right of publicity, moral rights, or other intellectual property right recognized by any applicable jurisdiction.
    • Links to Third-Party Web Sites: Links on the Site to third-party web sites or information are provided solely as a convenience to you. MOCHI is not responsible for such web sites or their content.

    • MOCHI cannot guarantee that files available for downloading through the Site will be free of software viruses or other harmful computer code.

    • You agree to indemnify, defend, and hold harmless MOCHI, its parent companies, subsidiaries, and other related entities from claims arising out of your use of the Site or violation of these Terms.

    • Your use of the Site is subject to MOCHI's Privacy Policy.

    • Entire Agreement/No Waiver: These Terms constitute the entire agreement and no waiver by MOCHI of any breach shall be deemed a waiver of any subsequent breach.
    • Correction of Errors: MOCHI reserves the right to correct any errors, inaccuracies, or omissions in the Content.
    • Enforcement/Choice of Law/Choice of Forum: Disputes relating to these Terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes shall be subject to the jurisdiction and venue of federal or state courts in Boston, Massachusetts.
